Terms and Conditions
Introduction
These Terms and Conditions ("Agreement") govern your use of Valevox Limited's services, specifically the purchase and use of a global data-only eSIM plan ("Plan") on your personal device ("Device").
Valevox Limited is registered in the Isle of Man (Company No. 138292C) with its registered office at: Valevox Limited, Old Castletown Road, Braddan, Isle of Man, IM4 1BB.
By purchasing, downloading, activating, or using a Plan, you agree to be bound by these Terms and Conditions.
Important Notice
Valevox Global eSIMs are data-only products.
Voice calls, SMS messages, MMS messages, telephone numbers, and emergency calling services (including 999, 112, and 911) are not supported.
The Service provides mobile data connectivity only. Internet-based communication applications such as WhatsApp, FaceTime, Telegram, Signal, Microsoft Teams, Zoom, and similar services may be used over the data connection, area dependant.
Before purchasing, please ensure your Device is eSIM compatible, network unlocked, and configured to allow data roaming.
Purchasing and Activating an eSIM Plan
- To purchase a Plan, you must provide your email address, physical address, payment information, and accept these Terms.
- A login link will be sent to your registered email address whenever you sign in.
- The Plan enables the use of a single reusable global eSIM, pre-paid through the Valevox website.
- An internet connection is required to download and activate the eSIM.
- Your Device must be eSIM compatible, network unlocked, and capable of supporting roaming.
- The eSIM must be configured to allow roaming.
- The Plan provides mobile data services only.
- The Service does not include traditional voice calling services, SMS messaging services, MMS messaging services, emergency calling services, or a telephone number unless expressly stated otherwise.
- Customers may use internet-based communication applications over the data connection.
- The eSIM remains the property of Valevox and may be reused for future purchases, recharges, and additional data plans where supported.
Service Description
- Valevox provides a global data-only eSIM service enabling internet connectivity through participating mobile network operators.
- The Service is intended solely for mobile data transmission and internet access.
- The Service does not provide mobile voice calling, SMS messaging, MMS messaging, premium-rate services, short-code services, or emergency calling services.
- Customers are responsible for using suitable third-party applications if they wish to make voice or video calls over the internet.
Duration and Termination
This Agreement begins when you purchase a Plan.
You may remove the eSIM from your Device at any time. Removing the eSIM will prevent access to the Service.
This Agreement will terminate if:
- You cancel the Plan.
- You breach these Terms or applicable laws.
- The purchased data allowance is exhausted.
- The validity period of the Plan expires.
- Valevox terminates the Service in accordance with these Terms.
Data Use, Plan Changes and Cancellations
- To switch Plans, contact customer support. Additional charges may apply.
- You may cancel your Plan at any time through your account or by contacting customer support.
- No refunds are available for unused data except where required by law or expressly provided in these Terms.
- Cancelled Plans cannot be paused, reinstated, or reactivated.
- If you exhaust your data allowance, you may purchase additional data or a new Plan.
Data Expiry
- Any unused data remaining at the end of the Plan validity period will automatically expire.
- Expired data cannot be refunded, transferred, exchanged, or carried forward unless expressly stated otherwise by Valevox.
Plan Updates
- Valevox may amend Plan features, pricing, or conditions.
- Where changes materially affect your rights, at least 30 days' notice will be provided where reasonably practicable.
- Continued use of the Service constitutes acceptance of the updated terms.
Cancellation Rights
- You may cancel your purchase within fourteen (14) days of purchase without penalty, provided the eSIM has not been downloaded, installed, activated, or used.
- By downloading, installing, activating, or using the eSIM, you expressly request the immediate supply of digital services and acknowledge that your statutory right to withdraw may be lost once activation or use has commenced.
- Subscription management and cancellation requests may be completed via the website or customer support.
Withdrawal Rights
- Consumers may withdraw from their purchase within fourteen (14) days unless the eSIM has been downloaded, installed, activated, or used.
- To exercise withdrawal rights, you must clearly notify Valevox using the contact details listed below.
- Nothing in these Terms affects any statutory rights that cannot legally be excluded.
Warranty
- Your statutory consumer rights remain unaffected.
- Except where required by law, Valevox provides no additional warranties regarding uninterrupted service availability, network coverage, or compatibility.
- Valevox reserves the right to discontinue any Service or product at its discretion.
Service Availability
- Valevox aims to provide reliable service but does not guarantee uninterrupted access.
- Service availability depends upon third-party mobile network operators.
- Coverage, connection speeds, latency, and service quality may vary by location, Device, network congestion, local regulations, and other factors outside Valevox's control.
- Valevox does not guarantee minimum speeds, uninterrupted access, or coverage in all locations.
- Outages may occur due to maintenance, network failures, or other circumstances beyond Valevox's control.
- The Service is data-only and should not be relied upon for voice communications, SMS messaging, emergency communications, or other critical communications.
- Emergency calling services (including 999, 112, 911, or equivalent emergency numbers) are not supported through the Service.
- Customers must maintain alternative means of making voice calls and contacting emergency services.
Device Compatibility
- Customers are responsible for ensuring their Device is eSIM compatible, network unlocked, and capable of supporting roaming.
- Valevox is not responsible for incompatibility caused by carrier restrictions, software updates, manufacturer limitations, regional device variations, or incorrect configuration.
Age Requirement
- You must be at least eighteen (18) years old or have permission from a parent or legal guardian to purchase and use the Service.
User Responsibilities
- Use the Service lawfully and in accordance with these Terms.
- Do not misuse, interfere with, or attempt to reverse engineer the Service.
- Do not exploit promotional offers or engage in fraudulent activity.
- Do not use the Service for unlawful, abusive, harmful, or network-disruptive activities.
- Valevox may suspend or terminate the Service where misuse, fraud, or unlawful activity is suspected.
Payment Terms
- Payment must be made through approved payment methods available on the Valevox website.
- Prices may include applicable taxes, duties, VAT, GST, or similar charges.
- Payments are processed automatically using your selected payment method.
Refunds and Returns
Contact Valevox if the Service does not perform as reasonably expected due to a fault attributable to Valevox.
Full refunds may be available where:
- The Plan was purchased directly from Valevox.
- The eSIM has not been downloaded, installed, activated, or used.
- The refund request is submitted within fourteen (14) days of purchase.
Partial refunds may be available where:
- The eSIM was partially used.
- Service disruptions caused by Valevox materially prevented use of the Service.
- Device incompatibility is proven and all eligibility criteria are satisfied.
- Other exceptional circumstances are approved by Valevox at its sole discretion.
Refund requests based solely on the absence of voice calling, SMS messaging, telephone numbers, or emergency calling functionality will not be accepted where these limitations were clearly disclosed before purchase.
Intellectual Property
- All trademarks, branding, content, software, and materials are owned by Valevox or its licensors.
- You may not reproduce, modify, distribute, or commercially exploit any content without prior written permission.
Data Protection
- Valevox collects and processes personal information in accordance with its Privacy Policy and Cookies Policy.
- Customers must provide accurate, complete, and lawful information when purchasing Services.
- Personal information may be processed by service providers and network partners where necessary to deliver the Service.
Indemnity
You agree to indemnify and hold harmless Valevox, its directors, employees, contractors, and affiliates against any losses, claims, liabilities, damages, costs, or expenses arising from:
- Your breach of this Agreement.
- Your misuse of the Service.
- Your violation of applicable laws or third-party rights.
Force Majeure
Valevox shall not be liable for any delay, interruption, degradation, or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including natural disasters, acts of government, war, terrorism, cyberattacks, internet outages, labour disputes, power failures, supplier failures, or third-party network outages.
Liability Limitation
To the maximum extent permitted by law, Valevox's total aggregate liability arising from or relating to the Service shall not exceed the greater of:
- £100; or
- The total amount paid by the customer for the affected Service during the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in this Agreement excludes liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any liability that cannot legally be excluded.
Consumer Rights
- Nothing in this Agreement excludes, restricts, or limits any statutory consumer rights that cannot legally be excluded under applicable law.
- Customers may be entitled to additional rights depending on their country or region of residence.
Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the Isle of Man.
The courts of the Isle of Man shall have exclusive jurisdiction, except where mandatory consumer protection laws provide otherwise.
Changes to Terms
- Valevox may amend these Terms from time to time.
- Updated versions will be published on the Valevox website.
- Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
General Terms
- Valevox may assign or transfer its rights and obligations under this Agreement without your consent.
- If any provision of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Failure to enforce any right shall not constitute a waiver of that right.
- The English language version of this Agreement shall prevail in the event of any translation discrepancy.
